IP Searches & Freedom-to-Operate

Trade mark, design and IP clearance before filing, launch or investment

Searches are designed to identify obstacles before a company invests in a name, product appearance, market launch or transaction. The objective is not merely to produce a list of earlier rights, but to assess which results are legally relevant, what level of risk they create and which practical options remain available.

Trade mark searches

  • Identical and similarity searches for Romanian trade marks.
  • EU trade mark clearance before EUIPO filing.
  • Owner and portfolio searches.
  • Class-specific and market-specific searches.
  • Assessment of earlier marks likely to support opposition or cancellation proceedings.
  • Review of coexistence patterns and crowded-field conditions where relevant.

Design and product appearance searches

  • Prior design searches before filing.
  • Review of registered designs relevant to a product category.
  • Comparison of overall visual impression and key design features.
  • Preliminary assessment of whether a proposed product appearance may create infringement exposure.

Freedom-to-operate analysis

  • FTO work is broader than registrability. It asks whether the contemplated commercial activity can proceed without creating an unacceptable risk in relation to earlier rights. The scope depends on the right involved, the territory, the product and the intended use.

How results are delivered

  • We separate blocking rights, material risks, lower-level similarities and background results. Where appropriate, the report includes recommendations: proceed, modify, narrow, seek consent, acquire rights, challenge an earlier registration or select another sign.
